Welcome to FuseCake.
These Terms and Conditions ("Terms") govern your access to and use of the FuseCake website, available at fusecake.in, and any related mobile applications, products, features, and services provided under the FuseCake name (collectively, the "Service").
FuseCake is operated by B S Vivek Nairy, a sole proprietor based in Bengaluru, Karnataka, India.
By creating an account, accessing, or using FuseCake, you agree to these Terms. If you do not agree with these Terms, you must not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use FuseCake.
By using the Service, you represent that you meet this age requirement and have the legal capacity to agree to these Terms.
If you use FuseCake on behalf of a company, startup, organization, or other entity, you represent that you have the authority to use the Service on its behalf.
2. About FuseCake
FuseCake is a startup-focused platform designed to provide tools that may include:
- Startup idea validation;
- Startup and business management tools;
- Brand-building tools;
- Team and workspace management;
- Attendance and working-hours tracking;
- Task and collaboration features;
- Team communications and chat;
- File and document sharing;
- AI-powered tools and outputs; and
- Other startup-related features introduced from time to time.
FuseCake may modify, add, replace, suspend, or discontinue features as the platform develops.
3. User Accounts
Certain features require you to create an account.
You agree to provide accurate and current information and to keep your account information updated.
You are responsible for maintaining the confidentiality and security of your login credentials and for activities performed through your account.
You must notify FuseCake promptly if you believe your account has been accessed without authorization.
FuseCake is not responsible for losses caused by your failure to protect your account credentials, except where responsibility cannot legally be excluded.
4. Workspace Accounts and Administration
FuseCake allows users to create and participate in collaborative workspaces.
A user who creates or administers a workspace may have administrative control over the workspace and information generated within it.
Depending on the features available, workspace founders and authorized administrators may be able to access information relating to workspace members, including:
- Attendance records;
- Clock-in and clock-out information;
- Break records;
- Working hours;
- Tasks and work-related activities;
- Workspace files and documents;
- Team communications and messages; and
- Other information generated within the workspace.
By joining a workspace, you acknowledge that information created or shared within that workspace may be accessible to the workspace founder or authorized administrators.
Workspace owners are responsible for ensuring that their collection, monitoring, and use of team-member information complies with applicable laws and that members receive any notices or consents required by law.
5. Attendance and Work Tracking
FuseCake may provide tools for recording attendance and work-related activity, including:
- Clock-in times;
- Clock-out times;
- Break periods; and
- Total working hours.
FuseCake does not currently capture employee screenshots as part of its attendance-tracking functionality.
Workspace owners are responsible for deciding how they use attendance information and for complying with applicable employment, privacy, and workplace-monitoring laws.
FuseCake provides the technology but is not the employer of workspace members and is not responsible for employment decisions made using information available through the Service.
6. User Content
Users may upload, create, store, or share content through FuseCake, including startup ideas, text, messages, logos, images, documents, files, brand assets, and other materials ("User Content").
You retain ownership of the intellectual property rights you hold in your User Content.
By uploading or storing User Content on FuseCake, you grant FuseCake a limited, non-exclusive right to host, store, process, transmit, and display that content solely as reasonably necessary to provide, maintain, secure, and improve the Service.
You are responsible for ensuring that you have the necessary rights and permissions to upload and use any content you submit.
You must not upload content that infringes another person's intellectual property, privacy, or other legal rights.
7. Workspace Data Ownership
As a general principle, the creator of original intellectual property retains ownership of that intellectual property.
Workspace owners may control the administration and management of organizational data contained within their workspace, subject to applicable law and any agreements between the workspace owner and its members.
FuseCake does not determine ownership disputes between workspace members, employees, founders, contractors, or organizations.
Users and organizations are responsible for establishing their own agreements regarding intellectual property ownership where appropriate.
8. Startup Ideas and Confidential Information
FuseCake understands that users may enter startup ideas and business-related information into the platform.
FuseCake will handle personal and platform data in accordance with its Privacy Policy. However, users should not submit highly sensitive trade secrets, passwords, private authentication credentials, financial credentials, or information where unauthorized disclosure could cause substantial harm unless they are satisfied that the relevant feature is appropriate for storing such information.
FuseCake does not claim ownership of startup ideas submitted by users.
Users remain responsible for protecting their intellectual property through appropriate legal measures where necessary.
9. AI-Powered Features
FuseCake may provide features that use artificial intelligence or automated systems.
AI-generated information may include startup validation results, recommendations, analysis, market insights, branding suggestions, content, or other outputs.
AI-generated outputs may be incomplete, outdated, inaccurate, or unsuitable for a particular purpose.
You should independently evaluate important information before making business, financial, legal, investment, hiring, or strategic decisions.
FuseCake does not guarantee the accuracy or reliability of AI-generated outputs.
Use of AI-generated information is at your own discretion and risk.
10. No Guarantee of Business Success
FuseCake is a startup-support and management platform.
Using FuseCake does not guarantee:
- Business success;
- Product-market fit;
- Customer demand;
- Revenue or profitability;
- Investment or funding;
- Successful fundraising;
- Customer acquisition;
- Accurate market predictions; or
- Any specific business outcome.
Startup validation scores, reports, recommendations, and other information should be treated as informational tools rather than guarantees.
Users remain responsible for their own business decisions.
11. Private Communications
FuseCake may provide private workspace communication and messaging features.
Private workspace communications are intended for authorized members of the relevant workspace. Depending on workspace permissions and functionality, workspace founders or authorized administrators may have access to communications within their workspace.
FuseCake does not routinely access or review private workspace communications.
However, limited access may occur where technically necessary to operate, secure, troubleshoot, or maintain the Service, respond to a valid legal obligation, or investigate serious misuse where permitted by applicable law.
12. Acceptable Use
You may not use FuseCake to:
- Violate applicable laws or regulations;
- Harass, threaten, abuse, or harm others;
- Send spam or unauthorized communications;
- Impersonate another person or organization;
- Upload malware or malicious code;
- Attempt unauthorized access to accounts or systems;
- Interfere with FuseCake's security or operation;
- Exploit vulnerabilities without authorization;
- Scrape or automatically extract platform data without permission;
- Reverse engineer the Service except where applicable law expressly permits it;
- Upload unlawful or infringing content;
- Misuse AI-powered features for unlawful purposes; or
- Use FuseCake in a way that materially harms the platform or other users.
13. Suspension and Termination
FuseCake may restrict, suspend, or terminate an account if a user violates these Terms, misuses the Service, creates a security risk, engages in illegal activity, or causes material harm to FuseCake or its users.
Where appropriate, FuseCake may provide notice before taking action. Serious violations may result in immediate suspension or termination.
14. Account Deletion
Users may request or initiate deletion of their accounts.
When an account and associated workspace are scheduled for deletion, certain information may remain recoverable for up to 30 days before permanent deletion from active systems.
Some information may be retained for longer where reasonably necessary for security, fraud prevention, legal obligations, dispute resolution, or enforcement of agreements.
Deletion of an account may result in permanent loss of workspace information.
15. Fees and Future Paid Services
FuseCake is currently available free of charge.
FuseCake may introduce paid plans, subscriptions, or premium features in the future.
If paid services are introduced, applicable pricing, billing terms, renewal conditions, and cancellation or refund policies will be presented before a user purchases a paid service.
The introduction of paid features does not automatically require existing users to purchase them unless clearly communicated.
16. Intellectual Property
The FuseCake platform, including its name, branding, logo, software, platform design, original interface elements, and other proprietary materials, is owned by or licensed to the operator of FuseCake, except for User Content and third-party materials.
These Terms do not grant users ownership of FuseCake's intellectual property.
Users may not copy, reproduce, sell, redistribute, or commercially exploit FuseCake's proprietary materials without authorization, except as permitted by law.
17. Third-Party Services
FuseCake may rely on third-party service providers, including infrastructure, authentication, analytics, and other technology providers.
These third-party services may operate under their own terms and privacy policies.
FuseCake is not responsible for independent third-party services outside its reasonable control.
18. Service Availability
FuseCake does not guarantee that the Service will be available without interruption or error.
The platform may experience downtime due to maintenance, updates, technical problems, security incidents, infrastructure failures, or circumstances outside FuseCake's reasonable control.
Features may be modified, replaced, or discontinued as the platform develops.
19. Disclaimer of Warranties
To the extent permitted by applicable law, FuseCake is provided on an "as is" and "as available" basis.
FuseCake does not make warranties regarding uninterrupted availability, complete accuracy, business results, or fitness for a specific business purpose.
Nothing in these Terms excludes rights or warranties that cannot legally be excluded under applicable law.
20. Limitation of Liability
To the maximum extent permitted by applicable law, FuseCake and its operator will not be liable for indirect, incidental, consequential, special, or business losses arising from use of or inability to use the Service.
This may include loss of profits, opportunities, business information, or data where such liability may legally be limited.
Nothing in these Terms limits liability that cannot lawfully be excluded or limited.
21. Changes to These Terms
FuseCake may update these Terms as the platform, business, or applicable laws change.
Material changes may be communicated through the platform, website, email, or another reasonable method.
Continued use of FuseCake after updated Terms become effective constitutes acceptance where permitted by applicable law.
22. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to applicable law, disputes arising in connection with FuseCake or these Terms shall be subject to the jurisdiction of the competent courts in Bengaluru, Karnataka, India.
